Article 1: general provisions


The e-commerce website of Lieke Knoops, a sole proprietorship   with registered office in Antwerp, KBO 0547.657.347 (hereinafter referred to as ‘Merfolk shop Europe’) offers its customers the opportunity to purchase the products from its webshop online.
These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the Mermaid Lelie web store, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted by Mermaid Lelie in advance, in writing.

Article 2: price


All prices stated are expressed in EURO, always the final price and all other duties or taxes required by the Customer.


Prices on Merfolk shop Europe include VAT.


The price statement refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: offer


Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding on Mermaid Lelie. Mermaid Lelie is only bound to an obligation of means with regard to the correctness and completeness of the information provided. Mermaid Lelie is in no way liable in the event of manifest material errors, typesetting or printing errors.


If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we request that the Customer contact our customer service in advance via hello@mermaidlelie.com
The offer is valid as long as stocks last and can be adjusted or withdrawn at any time by Merfolk shop Europe. Merfolk shop Europe cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.

Article 4: online purchases
Articles can be ordered in the webshop by choosing them and adding them to the shopping cart. At any time you can choose to continue shopping or to pay. As long as payment has not been made, the order can be changed.
When ordering for the first time, it is better to register. The advantage is that the data is stored so that everything goes faster the next time you order. If you are not registered, you can simply order as a ‘guest’.


Payments are made completely securely. Various payment options are offered:

  • via Bancontact
  • via paypal
  • via ideal
  • Bank transfer
  • with credit card (master card or visa)


After payment you will always receive a confirmation email.
Mermaid Lelie is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.

Article 5: delivery and execution of the order


After receipt of payment, the package will be prepared and shipped. Usually this will be delivered to your home within 2-3 weeks. The correct shipping date can be found with each item. If the ordered product is not in stock, you will be informed by e-mail and you can opt for a refund or to wait for the item to arrive.

The option for back order is also available on certain items. This is always stated on the sales page.


Items ordered through this web store are delivered worldwide. With the exception of certain products. The products always indicate when they will be shipped to a limited number of countries.


Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported by the Customer to Mermaid Lelie without delay.


The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods.


The delivered items remain the exclusive property of Mermaid Lelie until full payment has been made by the Customer.

Article 6: return/right of withdrawal


Our refund and returns policy lasts 14 days. If 14 days have passed since your purchase, we can’t offer you a full refund or exchange.

When you want to return an item, contact us via hello@mermaidlelie.com . If you send something back without contacting us first a refund is not guaranteed.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

The items are excluded from returns:

  • Digital courses and downloads are excluded from refunds due to the nature of the product.
  • Custom products are excluded since they are designed especially for you.
  • Swim wear due to hygienic reasons.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted:

  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any items that is been used.
  • Any item that is returned more than 14 days after delivery

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Sale items

Only regular priced items may be refunded. Sale items cannot be refunded.

Second hand items

All sales on second hand items are final

Exchange items

We only replace items if they are defective or damaged upon arrival. Provide us pictures of the defects or damage so we can inspect it. Without pictures it is not possible to ask for an exchange. Please contact us via hello@mermaidlelie.com .

Shipping on returns

To return your product, you should mail your product to: Lieke Knoops, Frans de Cortstraat 19 BE-2060, Belgium.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable.

You can choose your shipping partner, or ask for a shipping label via e-mail (hello@mermaidlelie.com). If you choose the second option, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Article 7: Shipping

Pricing

The price will be clearly indicated in the shopping basket. It is possible that you will see 2 calculation for shipping. Some items are shipped directly from the factory. That is why you can find double shipping prices in your bakset.

Shipping days

Shipping will be fulfilled every Wednesday.

Exceptions are:

  • bank holidays
  • owners vacation

When an exception is active you will ben notified with a pop up in the webshop

All apparel is shipped directly from the manufacturer. They strive to fulfill the shipment within a week. Upon checkout you get an estimated time of arrival.

Tracking

All items will have tracked shipping.

Pick up

Pick up is possible. If you want to use the pick up option you can indicate it during check out under the shipment options.

There is the possibility to pick up your package in Antwerp (Belgium). Every Wednesday.

When you are taking an in person course, the Merfolk swimming courses. Then you can indicate it during check out too.

Article 8: applicable law


These terms and conditions, all agreements and other legal relationships of/with mermaidiaanse.com are exclusively governed by Belgian law.
All disputes will be submitted exclusively to the competent court in Antwerp


Article 9: change of conditions


These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to, and the Mermaid Lelie general terms and conditions of sale. In the event of any contradiction, these Terms and Conditions shall prevail
